Terms of Service

These Terms of Service govern your use of the Tropical Air Kare website and any heating, ventilation, air-conditioning, indoor air-quality, maintenance, repair, installation, inspection, or related services provided by Tropical Air Kare. By using our website, requesting an estimate, scheduling an appointment, approving work, or purchasing services from us, you agree to these Terms of Service.
1. Services
Tropical Air Kare provides residential and commercial HVAC services, which may include system installation, replacement, inspection, diagnosis, maintenance, repair, cleaning, and indoor air-quality services.
The exact scope of work, equipment, materials, pricing, and estimated completion schedule will be stated in the applicable estimate, proposal, invoice, service agreement, or work order.
2. Estimates and Pricing
Estimates are based on the information available at the time they are prepared. Unless otherwise stated in writing, an estimate is not a guarantee of the final price.
Additional problems, concealed conditions, code requirements, equipment failures, inaccessible components, or other circumstances discovered after work begins may result in additional charges. Tropical Air Kare will make reasonable efforts to notify the customer and obtain approval before performing work that materially exceeds the approved scope or price.
Promotional offers, coupons, and discounts may be subject to separate conditions and may not be combined unless expressly stated.
3. Scheduling and Property Access
Appointment times and arrival windows are estimates and may be affected by weather, traffic, emergency service calls, equipment availability, or circumstances outside our reasonable control.
The customer must provide safe and reasonable access to the property, HVAC equipment, electrical panels, thermostats, attics, crawlspaces, and other areas necessary to perform the requested services.
An adult authorized to approve work should be present unless other arrangements have been approved in advance.
4. Customer Responsibilities
The customer agrees to:
- Provide accurate information about the property, equipment, and known system problems.
- Disclose hazardous conditions, restricted areas, animals, structural problems, water damage, mold, asbestos, or other safety concerns.
- Maintain a safe and accessible work area.
- Obtain any permissions required from the property owner, landlord, homeowners association, or other responsible party.
- Follow operating, maintenance, and safety instructions provided by Tropical Air Kare or the equipment manufacturer.
- Pay all approved charges when due.
Tropical Air Kare may suspend or refuse service if working conditions are unsafe, unlawful, inaccessible, or materially different from the conditions described when the appointment was scheduled.
5. Authorization to Perform Work
By approving an estimate, proposal, service agreement, or work order, the customer authorizes Tropical Air Kare to perform the described work and to use the equipment, parts, materials, and subcontractors reasonably necessary to complete it.
The person approving the work represents that they own the property or have authority to authorize the work and accept financial responsibility for it.
6. Payment
Payment is due according to the terms shown on the applicable estimate, invoice, proposal, financing agreement, or service agreement.
Deposits may be required for installations, special-order equipment, large repairs, or other projects. Unless prohibited by law or otherwise agreed in writing, special-order equipment and materials may be nonrefundable after they have been ordered.
Past-due balances may be subject to reasonable collection costs, returned-payment fees, late fees disclosed in the applicable agreement, and any other remedies permitted by law.
7. Cancellations and Rescheduling
Customers should provide reasonable notice when canceling or rescheduling an appointment. Tropical Air Kare may charge a cancellation, missed-appointment, or dispatch fee if such a fee was disclosed when the service was scheduled or in the applicable agreement.
Special-order equipment, permits, administrative expenses, completed labor, and other costs already incurred may remain payable after cancellation.
8. Equipment, Parts, and Availability
Equipment and parts are subject to manufacturer and supplier availability. Tropical Air Kare may substitute a reasonably comparable item if an approved product is unavailable, but will obtain customer approval before making a material substitution.
Delivery dates and project schedules may change because of supply-chain interruptions, manufacturer delays, weather, permitting, inspections, utility requirements, or other conditions outside our reasonable control.
9. Warranties
Any warranty provided by Tropical Air Kare will be stated in the applicable written estimate, proposal, invoice, installation agreement, maintenance agreement, or warranty document.
Manufacturer warranties are provided by the applicable manufacturer and are subject to the manufacturer’s registration requirements, exclusions, procedures, and limitations. The customer is responsible for completing any required warranty registration unless Tropical Air Kare expressly agrees to complete it.
Warranty coverage may be denied or limited when permitted by law if a problem results from misuse, neglect, improper maintenance, unauthorized repairs or modifications, electrical problems, power surges, flooding, fire, pests, corrosion, severe weather, structural defects, preexisting conditions, or failure to follow manufacturer instructions.
Except for warranties expressly provided in writing and warranties that cannot legally be excluded, Tropical Air Kare disclaims all other warranties to the fullest extent permitted by law.
10. Existing and Concealed Conditions
HVAC work may reveal preexisting or concealed problems, including defective wiring, damaged ductwork, inadequate drainage, refrigerant leaks, structural defects, mold, asbestos, water damage, code violations, or improperly installed equipment.
Unless expressly included in the approved scope of work, Tropical Air Kare is not responsible for repairing preexisting conditions, concealed defects, or damage caused by conditions that could not reasonably have been identified before work began.
11. Permits, Codes, and Inspections
When required and included in the approved scope, Tropical Air Kare may obtain permits and coordinate inspections. Permit fees, code-required modifications, engineering services, utility work, and inspection-related corrections may result in additional charges unless expressly included in the approved price.
Code requirements may change or may be interpreted differently by the authority having jurisdiction. Tropical Air Kare is not responsible for delays caused by permitting agencies, inspectors, utilities, or other governmental authorities.
12. Maintenance Plans
Maintenance plans and service memberships are governed by the terms provided at enrollment. Benefits, covered services, exclusions, renewal terms, cancellation procedures, and pricing will be described in the applicable plan agreement.
A maintenance plan does not guarantee that equipment will not fail and does not include repairs, parts, labor, or replacement unless expressly stated.
13. Website Use
The Tropical Air Kare website is provided for general information, appointment requests, customer communication, and access to available services.
You agree not to:
- Use the website for unlawful or fraudulent purposes.
- Attempt to disrupt, damage, or gain unauthorized access to the website or its systems.
- Submit false, misleading, malicious, or harmful information.
- Copy or commercially exploit website content without authorization.
Website information is not a substitute for an on-site professional inspection or diagnosis.
14. Intellectual Property
The Tropical Air Kare name, branding, website design, graphics, photographs, written content, and other materials are owned by or licensed to Tropical Air Kare and are protected by applicable intellectual-property laws.
No content may be copied, reproduced, distributed, modified, or commercially used without prior written permission, except as allowed by law.
15. Electronic Communications
By contacting Tropical Air Kare electronically, submitting an online form, or providing an email address, you consent to receive service-related electronic communications. Electronic records and communications may satisfy legal requirements that information be provided in writing, subject to applicable law.
16. SMS Terms and Conditions

17. Privacy
Our collection, use, retention, and protection of personal information are governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms of Service by reference.
18. Third-Party Services and Links
The website may contain links to financing providers, equipment manufacturers, payment processors, social-media platforms, or other third parties. Tropical Air Kare does not control and is not responsible for third-party websites, policies, products, services, security, or availability.
Transactions or agreements with third parties may be governed by separate terms between the customer and the applicable third party.
19. Limitation of Liability
To the fullest extent permitted by law, Tropical Air Kare will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, loss of use, or damage caused by service interruptions.
To the fullest extent permitted by law, Tropical Air Kare’s total liability arising from a particular service will not exceed the amount the customer paid Tropical Air Kare for that service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
20. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold Tropical Air Kare and its owners, employees, contractors, and representatives harmless from claims, losses, liabilities, damages, and reasonable expenses resulting from your unlawful conduct, breach of these Terms, inaccurate representations, or lack of authority to approve work.
21. Events Outside Our Control
Tropical Air Kare is not responsible for delays, interruptions, or failure to perform caused by events outside our reasonable control, including severe weather, natural disasters, labor shortages, supply interruptions, manufacturer delays, utility outages, government actions, emergencies, epidemics, fires, flooding, or transportation disruptions.
22. Governing Law
These Terms of Service are governed by the laws of the state in which Tropical Air Kare principally operates, without regard to conflict-of-law principles. Any dispute will be handled in a court with lawful jurisdiction unless the parties have entered into a separate written agreement requiring another dispute-resolution process.
23. Changes to These Terms
Tropical Air Kare may update these Terms of Service periodically. Updated Terms will be posted on the website with a revised effective date. Changes will apply prospectively unless otherwise required by law.
Terms contained in a signed estimate, proposal, service agreement, financing agreement, warranty, or work order may supplement these Terms. If there is a direct conflict, the signed agreement will control for the applicable service.
24. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.
25. No Waiver
A failure by Tropical Air Kare to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision later.
26. Entire Agreement
These Terms, together with the applicable Privacy Policy and any approved estimate, proposal, invoice, service agreement, warranty, financing agreement, or work order, constitute the agreement between the customer and Tropical Air Kare concerning the applicable website use or service.
